Litzau sentenced in Cass County

Cass County Attorney Christopher J. Strandlie reported Friday that Robert Arthur Litzau, 69, rural Pine River, was sentenced for the felony crimes of violation of predatory offender registration requirements and burglary of a dwelling for offenses occurring in the Pine River-Backus area between approximately May 5 and May 27, 2010.

District Court Judge John G. Melbye sentenced Litzau to serve a total of 24 months in prison on these two offenses, minus the time he has already spent in custody. Judge Melbye also imposed a 10-year conditional release period, which was triggered by the fact that Litzau is a Level 3 Predatory Offender. If Litzau fails to comply with any conditions of his release from prison, he could again be returned to prison for any time period deemed appropriate, up to the statutory maximum of five years. Litzau continues to be subject to predatory offender registration requirements.

Litzau was convicted on both counts on Oct. 27, 2011, after a three-day trial, prosecuted by First Assistant Cass County Attorney Barbara J. Harrington. The investigation was conducted by the Cass County Sheriff’s Office and the Minnesota Bureau of Apprehension-Predatory Offender Registration Unit.

This was Litzau’s second conviction for violation of registration requirements. He was convicted of a similar offense in Crow Wing County in 2009, for which he went to prison. Litzau also has current charges pending in Crow Wing County for a subsequent violation of registration requirements and obstructing legal process with force for an incident that occurred in Pequot Lakes last February in which a Pequot Lakes Police officer suffered minor injuries while attempting to arrest Litzau.

Litzau has an omnibus hearing scheduled for 9 a.m. April 9 in Crow Wing County District Court on those charges.
