Judge says Rodriguez's attorneys can subpoena prison workers
By DAVE KOLPACK Associated Press Writer FARGO, N.D. A federal judge says attorneys for Alfonso Rodriguez Jr. may subpoena Minnesota prison employees about Rodriguezs behavior behind bars.
Rodriguez, 53, a convicted sex offender from Crookston is awaiting a July 6 trial on a charge of kidnapping resulting in the death of University of North Dakota student Dru Sjodin of Pequot Lakes. He has pleaded not guilty.
Rodriguezs attorneys received permission earlier from U.S. District Judge Ralph Erickson to interview Joan Fabian, the Minnesota corrections commissioner, and Kevin Goodno, the state Human Services commissioner. Erickson added 15 corrections employees to the list last week.
Sjodin, 22, disappeared from the parking lot of a Grand Forks, N.D., shopping mall in November 2003. Her body was found the following April, in a ravine near Crookston.
Prosecutors have said they will seek the death penalty if Rodriguez is convicted.
Rodriguez was released from a Minnesota prison about six months before Sjodin was abducted, after serving a 23-year sentence for the violent attack on another woman. Defense attorneys describe Rodriguez as a model prisoner.
In death penalty cases ... the bottom line is that its permissible to show that a person like Mr. Rodriguez had a good record in prison, said Bob Hoy, Rodriguezs court-appointed attorney.
