Commissioners receive second notice of claim CASS COUNTY BOARD By MONICA LUNDQUIST Cass County Correspondent CASS LAKE -- Deer River attorney Frank Bibeau Tuesday served a notice of claim for a second client on the Cass County Board during the board's meeting at Cass Lake. The claim also is against Leech Lake Reservation Business Committee (Tribal Council).
He served the first notice on the county during a county board meeting a month ago on behalf of Leech Lake Tribal Council Secretary-Treasurer Arthur David "Archie" LaRose.
The notice served Tuesday is on behalf of Wallace Willard Storbakken. Both notices cited claims of "....false arrest, false incarceration and other deprivations of civil rights and liberties..."
Tuesday's notice states Storbakken was arrested while attempting to attend the quarterly meeting for Leech Lake Reservation at Palace Casino in Cass Lake April 1. The Storbakken notice seeks a claim of $250,000.
The board referred this notice of claim like that from LaRose to County Attorney Earl Maus and Minnesota Counties Insurance Trust.
When contacted Wednesday morning, Maus said he is not aware that the county has been served with an actual claim as a follow-up to these notices of intent. He said he does not expect MCIT to assign an attorney to review these cases until such time as a formal claim actually is filed.
Chief Sheriff's Deputy Tom Burch, also contacted by telephone Wednesday, said he did not recall exact details surrounding Storbakken's arrest and that he believed it was more a tribal issue than one involving the county.
