Brainerd mom goes to prison for sexually assaulting son

A Brainerd mom was sentenced to more than nine years in prison for sexually assaulting her 5-year-old son, according to court documents.

Jessica Diane Stewart, 23, was sentenced Oct. 15 by Judge David Ten Eyck in Crow Wing County District Court to 109 months-nine years and one month-in the Minnesota Correctional Facility in Shakopee. She was given credit for 207 days of time served. Stewart will be on 99 years conditional release and have to register as a predatory offender when she is released from prison.

Stewart was convicted of felony second-degree criminal sexual conduct. Stewart had a significant relationship with a victim younger than age 16, in this case her 5-year-old son. The first-degree criminal sexual conduct charge with penetration with a victim younger than age 16 was dismissed.

According to the criminal complaint filed against Stewart:

• On May 12, 2015, Crow Wing County Social Services received a report that a 5-year-old boy may have been sexually abused by his mother. The boy had been in foster care in the county since August of 2014. On May 10, 2014, the boy's foster parent met with the boy's court-appointed guardian ad litem to discuss concerns about the boy's behavior. On or about May 11, 2015, the foster parent sent an email to a Crow Wing County social worker further about the boy's behavior.

• On May 18, 2015, a Brainerd police investigator obtained a recorded statement from the foster parent regarding the boy's behavior. According to the foster parent the boy had been trying to kiss their 5-year-old son and peek in on him while he was using the bathroom. They also observed the boy touching himself frequently in the bathroom and under a blanket. The foster parent had a conversation with the boy on May 9, 2015, about his behaviors. The boy explained his mother touched his private part, he observed sexual acts with Stewart and her ex-boyfriend and he was sexually assaulted.

• The boy was interviewed May 15, 2015, by Family Advocacy Center in Bemidji. The boy said his mom started touching his private part when he was 4 or 5. He said it happened in the living room, which he said was his mom's room and no one else was there. The boy circled the private part on a male anatomical drawing and identified the female part.

• The Brainerd police investigator obtained a recorded statement from Stewart. She said she was in treatment from July 17, 2014, to Sept. 11, 2014, and that prior she lived at her mom's house off and on in northeast Brainerd. She said her son was in foster care while she was in treatment.

• Stewart admitted that her son walked in on her once while she was touching herself. At that time her room was the living room. Stewart said she and her ex-boyfriend watched child pornography and she would role play. She said one instance her son was in bed with them, while they watched porn on a phone. The complaint said the boy was sexually assaulted that same night. The boy was made to engage in sex acts with the mother.

• Stewart said the incidents occurred between July of 2012 to June of 2013.
