A 29-year-old Brainerd man, facing two domestic assault charges, will have his next appearance in Crow Wing County District Court at 9 a.m. Wednesday.
Jeremy Antoine Lee Brown was charged Oct. 21 with felony domestic assault by strangulation and gross misdemeanor domestic assault - a subsequent violation.
According to the criminal complaint filed against Brown:
• At 10:07 a.m. Oct. 19, Brainerd officers were dispatched to a residence on Fourth Avenue Northeast in Brainerd regarding a physical domestic assault. Officers arrived and were advised that there was noise coming from an upstairs apartment which sounded like a domestic assault. Officers located the apartment, knocked on the door and announced themselves, but received no response. After knocking several more times and again announcing themselves and no response, the door to the apartment was breached and officers entered.
• An officer heard a female crying and whimpering. He opened the door and observed she was sitting on a bed. The officer also observed a man kneeling on the floor of the west side of the room at the foot of the bed. The officer removed the male, identified as Brown, from the bedroom. The other officer spoke with the female. The officer observed she was crying and appeared to be very emotional. She was shaking, extremely upset and had a hard time talking, the complaint read. She said she was afraid to say anything because Brown may overhear her. • After being assured that Brown had been removed from the apartment, the woman said they were involved in a romantic relationship and had been together for a year. She said there was a verbal argument between them that started when the female learned Brown had another female at the residence. During the verbal argument, the female observed he was very upset to the point where she felt that he was going to get physical with her and she went into the bedroom and locked herself in. After she did that, the defendant then "booted" the door in and he began punching her all over, the complaint read. The victim said he punched her, threw her up against the wall, hit her and punched her all over and at one point he had his hands around her neck while she was up against the wall. She said Brown then threw her onto the bed, got on top of her and began punching her. As he was doing so, Brown held her throat with one hand, cutting off her air. The female said she struggled to breath and at one point couldn't breath, so she began punching him back.

• Eventually she said Brown got off her and then she located the phone, but he threatened her and told her not to call the police. At that point, she texted her friend to get ahold of the police and the friend subsequently called 911.
• The officer asked her if she had heard the police knocking at the door and she indicated she did and was going to answer the door, but Brown told her not to answer it and told her to go into the bedroom and close the door. Brown also went into the bedroom, she believes to keep her in there.
Brown has a criminal history of domestic assault and was convicted of it on Feb. 23, 2012.
Judge Earl Maus set bond without conditions at $30,000 or $15,000 with conditions. Conditions include he cannot enter the victim's residence, cannot leave the state, cannot have contact with the victim, must remain law abiding and make his court appearances.
Brown is being represented by Mark A. Mitchell, a public defender. On Oct. 30, Mitchell filed a Rule 9.01, "Defendant's Demand for Disclosure." In the letter, the attorney "demands the state to make the following written disclosures prior to such time as the defendant is required to waive or demand a hearing on the issue of probable cause." The court document asks for the written and recorded statements and copies of audio tapes made by Brown and all materials that tend to negate or reduce the guilt of the defendant.
