Emily man faces stalking charge

Police observed multiple injuries on the victim, who stated she was afraid for her safety. Man charged tells police he was afraid of her.

A 26-year-old Emily man faces stalking charges after he allegedly choked, pushed and head-butted a woman in an apartment in Ironton.

Kyle Joseph Frank was charged Friday, Aug. 27, in Crow Wing County District Court in Brainerd with felony stalking. The criminal charge follows a 911 call to the Crow Wing County Sheriff’s Office at 8 a.m. Thursday for a domestic assault at a residence on Fourth Street in Ironton. The victim, who is known to Frank, reported he assaulted her and she went to the hospital for medical attention, the complaint filed against the man stated.

The victim stated the landlord at the residence told her Frank could no longer stay there. When she told Frank at noon Aug. 25 that he had to move out, he became upset. The two spoke for a while and then Frank became violent, the complaint stated. Frank reportedly pushed her up against a doorframe and strangled her. She reported the assault went on until about 2-3 p.m. and then he left. He returned around 5 p.m. and they had another discussion about him moving out. Frank again became violent and pushed her before he left around 5:30 p.m., the complaint stated. Frank then returned about 4 a.m. Thursday and became even more upset due to her friend being at the apartment. Frank threw items around the apartment and pushed the victim. At some point during the assault, Frank pushed a dresser and it tipped over and landed on the woman’s toe, which later was found to be broken when she had X-rays done. Officers observed the following injuries on the victim — bruising to her middle-right triceps, lower back, upper chest, and right foot; and her large toe appeared to be heavily bruised and swollen.

Officers spoke with the friend who stated the victim asked him to come to her residence as she was afraid for her safety. The friend stated Frank was angry and cursing when he arrived at the residence. The friend said he didn’t want to be involved so he walked out of the apartment but observed through the open door Frank holding the woman up against the kitchen sink. The friend said he and the victim then left and went to his residence and she left shortly after to go to the hospital.

When he was arrested, Frank told deputies he had been living in the residence for a number of months without the victim and the victim was upset that Frank would not let her live there. Frank stated she became upset and he was afraid of her, so he left the apartment to avoid conflict.

Another witness showed deputies two videos she recorded showing Frank and the victim screaming at each other, Frank charging at the victim and picking her up and throwing her to the ground.

Frank, who has since posted bond and was released from jail, is scheduled for his next court hearing Sept. 16.
