A 53-year-old man, who was physically uncooperative with Brainerd police officers, kicking one officer, has been charged.
Albert Santos Correia of Brainerd was charged Wednesday in Crow Wing County District Court with felony fifth-degree drug possession; two gross misdemeanors counts of fourth-degree assault of a police officer and obstructing the legal process; misdemeanor disorderly conduct; and petty misdemeanor of possessing drug paraphernalia.
According to the complaint filed against Correia, Brainerd police officers responded to a report at 11:28 p.m. Tuesday of a suspicious person near the 500 block of Southeast 12th Street in Brainerd. Officers made contact with Correia, who was lying in the fetal position and smelled strongly of alcohol. He was sitting in an area that was wet and muddy, and when he spoke to officers his answers to their questions did not make sense and did not answer their questions.
As he spoke with the officers, Correia began to raise the volume of his voice, and he used a swear word multiple times in sentences, the complaint stated. Correia continued to shout profanities towards one of the officers and two other individuals standing outside their residences a block to the east. Corrieia was advised by the officers he was being placed under arrest for disorderly conduct. Correia immediately began to tense his arm and clenched both fists. He became physically uncooperative with officers, to the point he had to be brought to the ground and be pepper sprayed, the complaint stated. While attempting to place Correia in a squad car, Correia kicked one of the officer's in the right shin, causing him temporary pain.
A subsequent search of Correia yielded a glass pipe that contained methamphetamine.

Correia has a prior controlled substance conviction from a 2014 incident.
Bail was set at $20,000 without conditions for Correia, who was still in custody Thursday in the Crow Wing County Jail.
