A 52-year-old Brainerd man faces domestic assault and punishing a child charges following a March 28 incident at a residence in Crosby.
Jimmie Robert Benjamin was charged Thursday in Crow Wing County District Court in Brainerd with felony domestic assault by strangulation, gross misdemeanor malicious punishment of a child and misdemeanor domestic assault to intentionally cause bodily harm.
Benjamin was released from jail on his own recognizance. Benjamin's next court hearing is May 30.
According to the probable cause court document, Crosby police were dispatched at 11:26 a.m. March 28 to a report of a domestic assault. The victim, a 16-year-old male, reported Benjamin assaulted him. The juvenile's mother reported she and her son had gotten into a dispute earlier that day. The mother said she pinned the 16-year-old to the bed and he kicked her. She said she left and the victim attempted to leave the residence, when Benjamin grabbed him by the neck with one hand and slammed him on the ground, the complaint stated. The juvenile male stated he couldn't breathe when this was happening, and while he was on the ground, Benjamin placed his knee onto his chest. The juvenile male said Benjamin was stating that he is not to be disrespectful to women and he believed Benjamin was probably trying to discipline him, the complaint stated.
